Keep on the right side of the Law
There
are rules and Government guidelines on using data.
The Data Protection Act, Telephone and Fax
Preference Service and Email regulations all require
compliance. Breach these rules and you could
leave yourself open to prosecution and heavy fines.
Even if
you have your own database, unless you screen it
regularly and comply with the regulations you can
still be prosecuted. What's more, copyright
and intellectual rights exist on databases and
directories. You can use Yellow Pages, for example,
to find a product, service or company, but use it to
compile a list for marketing purposes and you are
infringing copyright.
While
most experienced marketeers see the investment and
value that goes into building and maintaining a
database, some people don't see the thousands of
phone calls and man-hours spent collecting and
updating the information.
This is
why database and directory suppliers use "seed
data"; that is, bogus contacts that are planted to
trace who is using their data. Data is
generally leased or rented for a one-off or multiple
use within a given time-frame, use it outside those
restraints and you will almost certainly breach
copyright laws.

Information, the office that regulates Data
Protection. What's more, we are an accredited
member of the Direct Marketing Association who
regulate the Telephone and Fax Preference Service,
and we screen data against the TPS/FPS opt-out list.
